Adopted dog from Petsmart has 2 broken legs, what do i do ?

    Hello, I live in Dallas, TX and I adopted 2 dogs from Petsmart on 9/3/19. One is a Pomeranian/Fox Terrier and the other is a Shih Tzu. The 2nd time i took the dogs out i noticed the Shih Tzu's left rear leg. He acted like he had stepped on a sticker so i stopped and felt underneath his paw to make sure because Petsmart didn't bother to groom or give him a bath and his hair was matted ALL OVER with burrs stuck in and mud, feces...and they had been their for a long time. Nothing was underneath his paw. A few days later when i took them on their first long walk i noticed that the Shih Tzu would keep the left rear leg up if he was kind of running. After using the bathroom, he only kicked his hind leg once but if their is dirt, he will kick his hind legs several times. I had 3 weeks to get the dogs a free vet exam and checkup so since i found out the Shih Tzu had been neutered on the 2nd and something wasn't right about his leg..i scheduled a vet appt for 9/13 at 8am. Vet took an xray and she said the Shih Tzu's left rear leg was broken about 2 months ago. It was clearly separated from the hip bone and had attempted to heal itself but couldn't. Most likely it had grown into the cartiledge of his leg. Not only that but his front right leg had been broken prior to the left rear leg being broken. It had tried to repair itself and almost did but their is still a small gap with a fuzzy area around the broken bone and the area where it should have healed. The vet said the xrays need to be sent off to a surgeon who can assess exactly what is going on and it needs to be done within the next 5 days because the only thing certain is that the dog will have to undergo surgery. Cost to send xray to surgeon $120.00 Surgery: estimated $1500.00 , During surgery , if unexpected treatment is needed, the entire Surgery cost needs to paid in full and half of the cost of the unexpected treatment will be due immediately. Outraged, i contacted Petsmart and i have filed a formal complaint with their Corporate Office & so far they have agreed to give the dogs a free grooming session although after telling the manager at the Petsmart where i adopted the 2 dogs, the vet results and wanting to get all the matted hair cut out , the parts that i can't do myself , she said the book of coupons i was given had a half off coupon for grooming and i almost hit the roof ! She claimed i would have to speak to Animal Care of Dallas where they got the 2 dogs and i did speak to Animal Care and both Petsmart & Animal Care would not take responsibility for the broken leg. On the 14th is when i filed a formal complaint with Petsmart wanting them to pay for everything. Cost to have the xray sent to a surgeon, the surgery, any pre-surgery expenses that are required as well as all costs associated with the dogs recovery and follow up visits. I'm staying in contact thru email with Customer Care and so far their is no resolution. My question is "Am i taking the right steps to get this adopted dog the help it needs >? Is their a certain agency i should contact about this matter that will be able to help Petsmart speed up their decision ? Am i doing the right thing ?

    Seems like you are taking all steps necessary. Maybe the next step is to get a lawyer

    Now i got it all figured out. Petsmart, Banfield hospital and VCA clinics are all under the same umbrella company. Their customer support team has been avoiding any specific question I ask about anything concerning the dog with the broken leg. They have no intentions whatsoever of filing a complaint to their corporate offices and their won't be any resolution. This dog was neutered and given a rabies shot in the right leg and their store vet never noticed this dog's broken leg ? No staff member noticed the dog limping around like i did the 3rd time i took it out to use the bathroom. Someone noticed, i know they did but they didn't document it because it's proof . This Petsmart is letting Animal Service Of Dallas use their space so customers can come in and adopt crippled, abused dogs that shouldve been euthanized because they are injured or are dangerous. Customer takes the dog home and they lure you into their VCA clinics with a free exam whereupon you are urged to get their Doggy Care plan. And all these mutts with medical needs are the abused neglected dogs and their is more money to be made if you act like a legit adoption agency than simply euthanizing them. They didn't even bother cleaning him up. They prob just got the dog and immediately put it in the cage for adoption. Knowing exactly what was wrong with it so they could milk me for thousands of dollar on a surgery that will be performed by Banfield hospital. I just caught on to the scam last nite after their last email again never addressed the issue of paying for surgery for it's 2 broken legs. Avoided my direct questions with nothing but fluff and they worded the email suggesting an appointent had been made when in fact the number they had me dial to contact their surgeon was nothing more than a prompt which didn't offer any way of connecting with any of the surgeons. Now why would Customer Service not send me directly to the surgeon who is waiting to speak with me as they said in their email. I wondered why they didn't acknowledge they received the dog's history and the bills for sending xray to the surgeon. I had to ask them if they recieved those pics of his history and they avoided the question and did not answer me. How could i have been so stupid. After i put it all together, all the weird responses, avoiding every question i asked. They know i'm on to their game and now they are refusing to respond to any of my emails. Tried to message them on Facebook and no answer. Wow ! And they are getting away with it too.

    I'm going to have to read this more thoroughly. I am not a lawyer but I am a person who is resolute about anyone who is using animals as a commercial form of income generating and ESPECIALLY a franchise thoroughly inspecting and treating ANY maladies prior to adoption.
    It will ultimately boil down to this if you have to take it to arbitration.Were you made aware of any kind of health problems before adoption?Did you sign any contract or agreement with PetSmart agreeing to not hold them accountable for the overall health of the dog?
    Also did you sign any contract or agreement for YOUR sole responsibility to ensure the proper and complete health of the dog?
    The fact that they aren't responding generally means that the have been advised not to be responsive.Be firm and not rude or disrespectful to the company as well as persistent in your communications.
