    PetSmart Sued Over Alleged Grooming Death Of Puppy At Downey Store

    NORWALK (CBS) — A couple has filed a lawsuit against a Downey PetSmart, claiming that a groomer injured their puppy so severely that it died.

    The civil suit, filed Monday in Los Angeles Superior Court, claims that the 4-month-old English Bulldog named Rita, suffered injuries while in the pet store’s care that led to her death.
    According to the complaint, the unnamed plaintiffs brought their “healthy and happy puppy to PetsMart for a grooming” on May 12, 2011.

    “Shortly after dropping her off, they received a call that she was vomiting blood and that they should pick her up and take her to a veterinarian,” said Jill Ryther, attorney for the plaintiffs who specializes in animal law.

    The couple brought the puppy to a veterinarian where she died 45 minutes later.
    A necropsy was performed on the dog and it was determined the cause of death was likely strangulation that occurred while she was being groomed at the Downey PetsMart,12126 Lakewood Boulevard, the lawsuit claims.

    The plaintiffs also allege PetsMart ordered the puppy be cremated before the owners could retrieve her body.
    The “plaintiffs were horrified, as this was done against their wishes, beliefs and without their consent,” Ryther said.

    The couple is seeking damages upwards of $25,000 from PetsMart, said Ryther.
    “The facts as represented in the recently distributed press release by an attorney are not what we believe to be true relative to this unfortunate situation. As a practice, however, PetSmart does not comment on pending litigation,” Michelle Friedman, spokesperson for PetsMart, said.

    The lawsuit also claims “PetsMart has been under fire as well as sued in the past for similar incidents.”

    I question what authority PetSmart has to order that the puppy be cremated.

    I'm confused on this point: If the Plaintiffs (presumably the owners of the puppy) did this: The couple brought the puppy to a veterinarian where she died 45 minutes later. How did PetSmart get custody of the puppy and order its cremation? :scratch:

    Same questions here DD......
    What I believe is being said here....(I'm going out on a limb) is..... the Owners took the puppy to the Vet, the puppy died.
    I'm guessing that PetSmart called the Vet's office and ordered the Cremation.....

    But why would the Vet's office take a command from someone who is not the owner of the dog nor their client ?

    After watching the video, it seems that PetSmart ordered the necropsy on the puppy. What remains unclear is where the necropsy was performed and who was in custody of the body at the time. The necropsy report that PetSmart ordered, appears to be damaging to their defense. This case seems befitting of a negligence and punitive damages award.

    not sure how much grooming a 4 mo old English bulldog needs besides a basic bath and brush out, clean ears, folds dried, not sure how strangulation occured? I know they have difficulty breathing and if it stressed out, which a 4 mo could easily do, since that is the fear period of development, I wonder if it freaked out and tried to pull out of the tether, most groomers for short nose dogs put the loop thru 1 leg also, so it doesn't happen, so many questions...mmmm...Curious....

    In Albuquerque over 5 dogs have died from petcos or petsmart just since January It is best to take your animals to a local grooming shop! At places like petsmart and petco they dont care what happens to your dog becuase 10 more people will come in

    So true! I've been taking mine to a local groomer for almost 11yr. now. :)

    I am groomer and the horror stories I have heard from places like that! How about the just sell pet supplies and leave the grooming to people that actually care for dogs well being and know what they are doing!!!!

    Please don't make "generalized" statements, or "lump" all types of ppl together, you may offend some. If there are some PetSmart groomers who don't care, don't lump all together, there are actually really good groomers at these places, and actually really bad groomers that have private businesses.
    Just because I have a bad experience at the salon down the street, I am not going to lump the whole group and say it's bad, that does a disservice to those at that salon that do care and do a great job, I just happened to get the one groomer who is an idiot or inexperienced, try a diff one. I'ts the same for trainers, you get a bad one and all of them are lumped together that they're bad, please make sure that if you have tried every groomer at every PetSmart, across the country and Canada and can't find one good one then go ahead and make that statement, if not then say "around here- insert name of city here- I have found none who are that good, or,I have checked the 2 near me and watched and they are not good". This's just a request, Thank you.

    I have a right to my option and my option in that PetCo's and PetSmart's do not have the proper training as grooming. Yes some private groomers are horrible to but From where I come from if you have worked at Petco or PetSmart your life as groomer is over if you do your research there are more animal deaths and animal accidents at groomers like that then the little shops put together Everyone has a right to there option this is America. I'm not trying to be rude but everyone has a right to say what they fell so if I feel all Petco's and PetSmart's are bad then that is my option and I put them in one lump statement if I feel! Thats is what an option is you don't have to like it but no everyone agrees with everyone! I thank you for your option and will not judge you on it Please don't judge others either!

    Well, I recently took JC to be groomed:) They have a groomer at my vet's office. Anyway, the groomer said he was wonderful. He got muzzled for the nail cut and then they massaged him and shampooed him without the muzzle. They sprayed him with Papaya doggy cologne:D I asked about how they dry the dogs. I did not want my dog in a cage with heat on him. I've heard alot of horror stories. They did a "cool" blow-dry on him. They even cut his hair around his neck. I was very happy and plan on taking him back.

    My friend took her dog to the PetSmart where I live and they were happy with the results.

    Even some of the ones at Petsmart are not bad either. :D

    I have to admit I was very nervous and "interviewed" the groomer at my vet's office before I let them touch my dog.

    I'm sure not every single person that works at Petco or Pet Smart is horrible with animals but its kinda like if every time you eat at McDonald's you get sick and everyone you know gets sick when eating at McDonald's you stop eating there! I am not saying anything bad about the people personly who work there its there training methods that I have trouble with. One example and proven is the teach there groomers to cut the nails intel a bleeds a little in make sure they are short enough! But its like getting a hang nail it hurts a little! I should have worded my statement differintaly It IS THE TRAINING not the people themselves Sorry for wording!

    They teach their groomers that the customer has no idea what they are talking about! They don't listen to what the costumer really wants I have come across so many people that have told me they took their dogs in for a bath and Brush and they have gotten their dogs backed shaved! The first 3 weeks of the training course is teaching them how to sell products and "upgrades" to the grooming! I had a friend that spent $5000.00 in grooming school could not find a job after she graduated at her local grooming shops so she went an appiled at Petco they told her they "had to completey retrain her because PetCo does things differnt!" After she worked at Petco no other groomer would even let her bath for them in option her $5,000 in training is ruined because of Petco on her Resume! I have one lady come to me to fix a town and country hair style on her poodle that Petco has messed up the shaved the dogs back with a 40 blade which is what the vet uses to removed all the hair before surgery! I had one gentleman that left his dog at Petco came back 4 and half hours later to pick up the dog and the dogs leg was broken and the groomer said he jumped out the kennel! He demanded to see the camera tapes and you saw clear as day the groomer pushed the dog of the table because he wouldn't sit still yes I admit that person would have done the same thing in any other shop but the differnce is at a local shop the owner would have been called right away she would have been fired and the shop would have paid the vet bills!

    I'm so glad none of my dogs require grooming! I bathe them, I clip them. My daughter shaves Kodi (wifey's Pom) twice a year in the summer so that he looks like a little Hyena and wifey clips his nails and bathes him as needed.

    I think Pom's are so cute shaved a groom one and she wants me to leave the air around the neck area and he looks like a little lion so cute!!!!!!
